Malpractice is about standard of care

The vast majority of medical malpractice cases do not involve doctors doing something they should not have done, but doctors failing to do something they should have done. Misdiagnosis of or failure to diagnose cancer, small bowel obstructions, brain hemorrhages and other serious medical conditions can also lead to a failure to treat those conditions, allowing those conditions to worsen when they could easily have been treated.
